End User License Agreement
Version 1.1 — Effective July 15, 2026
This End User License Agreement (the "Agreement") is between you and Telesmatic Systems, LLC ("we", "us", "our"), the operating entity of Lost Souls (the "Game"), and governs your access to and use of the Game, its websites, and its support systems (collectively, the "Service"). You accept this Agreement by affirmatively agreeing to it when prompted (in-game or on our websites), by creating an account, or, to the extent permitted by applicable law, by using the Service. You agree that your affirmative electronic acceptance constitutes your signature, and that this Agreement and the certifications and releases described in it constitute a writing signed by you. If you do not accept this Agreement, do not use the Service.
1. Eligibility
You must be at least 18 years of age to use the Service, and you are required to provide your date of birth before entering the Game. By using the Service you represent that you meet this requirement and that it is legal for you to view the Game's content in the jurisdiction from which you access it.
2. Your Account
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account, whether or not authorized by you; notify us promptly if you believe your account has been compromised. Accounts are personal to you, may not be sold, transferred, or shared, and are not transferable by inheritance or operation of law, though on request from a verified family member we may, at our discretion, memorialize or retire a deceased player's characters. Account, character, and organization names must not infringe the rights of others, impersonate our staff or other users, or be inappropriate as we determine in our discretion; we may rename any account, character, or organization, or reclaim any name, at any time. Accounts and characters that remain inactive for extended periods may be removed and their names made available for reuse.
3. License to Use the Service
We grant you a limited, personal, non-exclusive, non-transferable, revocable license to access and use the Service for your own non-commercial entertainment. All right, title, and interest in and to the Service and its content, other than as expressly granted here, remain with us. This license does not grant you any ownership of, or any other right or title to, any account, character, item, currency, attribute, or other data appearing in or arising from the Service. We may modify, suspend, or discontinue the Service, in whole or in part, at any time, with or without notice. You grant us the right to display and publish character names, deeds, statistics, and in-game events, and to use your character names, in-game personas, and public in-game activity, both within and outside the Game, in connection with operating and promoting the Service, without compensation.
4. Content Certification
The Game is a diverse fantasy-world setting that contains (and whose players and developers routinely use) explicit language. We do not presently have any adult content, but we reserve the right to create such as we find it appropriate to our setting. Content within the Service is user-generated and is not pre-screened or moderated in advance, and players can effectively create adult content via actions and descriptions. You may use the Service only if you wish to view explicit language and, potentially, adult content in text form, and it is legal for you to do so. You will be asked to certify this before entering the Game.
5. Contributed Content Release
The Game can be contributed to by participants in a variety of ways — by writing messages, creating items, contributing as a developer, providing ideas, suggestions, or feedback, or in any other way ("Contributed Content"). In order for us to operate, you agree as follows:
(a) You assign to us, without restriction, all rights and interests you hold in all Contributed Content, including copyright, whether contributed before or after your acceptance of this Agreement. Where Contributed Content is a joint work, you assign your entire interest in it.
(b) To the extent any such assignment is or becomes ineffective under applicable law, you grant us a perpetual, irrevocable, worldwide, royalty-free, fully sublicensable, and transferable license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, perform, and display such Contributed Content in any medium and for any purpose, including training machine-learning models.
(c) To the maximum extent permitted by applicable law, you waive any moral rights or similar rights you may have in Contributed Content and, to the extent such rights cannot be waived, you covenant not to assert them against us or our licensees. This waiver exists so that Contributed Content can be freely modified, integrated, and reused — not so that we can take credit for your work. We will not misrepresent the authorship of Contributed Content or claim that content you created was created by someone else, and although not every context permits crediting, we support attribution where practical (for example, in source code and creator credits).
(d) You represent and warrant that, excluding the Game's pre-existing content and materials we provide (upon which your contributions may build), your Contributed Content is your own work and that you have the right and authority to make the assignment and grant the license above with respect to your interest in it. You agree not to include in Contributed Content material owned by a third party without authorization, and to disclose to us any third-party material you are authorized to include. We may remove or modify any Contributed Content at any time, including material claimed to belong to a third party.
(e) We grant you a perpetual, non-exclusive, royalty-free license to use, reproduce, modify, and create derivative works from your own Contributed Content for any purpose, except that this license does not extend to using Contributed Content in, or to operate or populate, another multiplayer game or similar online service. This license, the license granted in Section 3, and your access to the Service are the consideration for this release.
(f) If you contributed content before reaching the age of majority, your acceptance of this Agreement after reaching majority constitutes your ratification of your prior contributions, assignments, releases, and certifications.
This assignment model is what allows a world built by volunteers over decades to survive its volunteers: a single owner can maintain, defend, and relicense the integrated whole without tracking down every past contributor. You also grant every other user a non-exclusive license to capture, quote, and share logs and recordings of publicly visible in-game content and activity, including your Contributed Content, for personal, non-commercial purposes.
If you are not willing to agree to this section, do not use the Service.
6. Conduct
You agree not to use the Service to violate applicable law, to infringe the rights of others, to harass other users, to disrupt or damage the Service or its systems, or to gain or attempt to gain unauthorized access to any account, system, or data. Other than through programs we ourselves offer, you agree not to sell, purchase, or exchange for real-world value any account, character, item, currency, or other element of the Service. We may establish and enforce additional rules of conduct within the Game. You are solely responsible for your interactions with other users; we have no obligation to become involved in, and no liability arising from, disputes between users.
You agree not to knowingly exploit bugs or unintended behavior for advantage (report them to us instead), and not to retain or traffic in anything obtained through such exploits; we may reverse or remove the products of any such activity. You agree not to use automation except as permitted by our in-game rules. You may not systematically extract, harvest, or archive substantial portions of the Service's content, use content from the Service to train machine-learning or artificial-intelligence models, or use Service content or data to operate or populate any other game or service, without our written permission. You may not impersonate, or falsely claim to speak for, our staff, our volunteers, or Telesmatic Systems, LLC. These conduct rules also apply in official community spaces we operate or officially relay to (such as our Discord channels).
You may report content or conduct you believe violates this Agreement or applicable law to starhound@lostsouls.org. We may, but have no obligation to, monitor conduct or content or to intervene; our review of any report is in our discretion; and our acting in one instance creates no obligation to act in another.
7. No Property Interest
You acknowledge and agree that you have no property interest, right, or title in or to any account, character, item, currency, attribute, position or standing in any player organization, or any other element of the Service, including any copy of Contributed Content stored on the Service, regardless of the time, effort, or consideration expended, and that all such elements exist solely as data on systems we control, which we may alter or delete at any time. We have no obligation to maintain, preserve, or return any copy of Contributed Content or other data stored on the Service; you are responsible for keeping your own copies of anything you wish to retain, and you release us from any claim arising from the deletion, loss, or destruction of copies of Contributed Content or other data stored on the Service.
8. Suspension and Termination
We may suspend or terminate your access to the Service, and may modify or delete any account, character, or other data associated with you, at any time, with or without notice, for any reason or no reason. Suspension and termination apply to you as a person, not merely to an account: we may extend them to any other account we reasonably believe is yours, a terminated user may not access the Service through any account without our permission, and knowingly providing a terminated user with access is a breach of this Agreement. You may ask the administration to reconsider an enforcement decision; any reconsideration and its outcome are in our sole discretion and final. You may stop using the Service, or request removal of your account, at any time. Sections 5, 7, 9, 10, 11, 12, 13, 14, 17, and 18 of this Agreement, the Records section below, and any other provision that by its nature should survive, survive any suspension or termination of your access and any deletion or removal of your account.
9. Indemnification
You agree to indemnify, defend, and hold harmless Telesmatic Systems, LLC and its members, managers, employees, and agents from and against any claims, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or relating to your Contributed Content, your use of the Service, or your breach of this Agreement, except to the extent a claim results from our own willful misconduct. We may assume control of the defense of any claim subject to this section, you agree to cooperate reasonably in any such defense, and you may not settle any such claim without our consent.
10. Disclaimer of Warranties
The Service is provided AS IS and AS AVAILABLE, without warranty of any kind. To the maximum extent permitted by applicable law, we disclaim all warranties, express or implied, including, but not limited to, the implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that any data will be preserved.
11. Limitation of Liability
To the maximum extent permitted by applicable law, in no event shall Telesmatic Systems, LLC or its members, managers, employees, or agents be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of data, profits, goodwill, or other intangible losses, arising out of or relating to the Service or this Agreement, however caused and on any theory of liability, even if advised of the possibility of such damages. Our total aggregate liability arising out of or relating to the Service or this Agreement shall not exceed the greater of the amount you have paid us in the twelve months preceding the claim or ten United States dollars (US$10).
Some jurisdictions do not allow the exclusion of certain warranties or the limitation or exclusion of certain damages. To the extent such laws apply to you, some or all of the disclaimers and limitations in Sections 10 and 11 may not apply, and our liability shall instead be limited to the maximum extent permitted by applicable law.
12. Governing Law and Disputes
This Agreement is governed by the laws of the State of Florida, without regard to its conflict of laws principles. Any dispute arising out of or relating to this Agreement or the Service shall be brought exclusively in the state or federal courts located in or serving Pasco County, Florida, and you consent to the personal jurisdiction of those courts.
To the maximum extent permitted by applicable law: (a) you and we each waive any right to a trial by jury in any such dispute; and (b) any dispute shall be brought in an individual capacity only, and not as a plaintiff or class member in any purported class, consolidated, or representative proceeding.
Before filing any claim against us, you agree to send a written description of the dispute and the relief you seek to starhound@lostsouls.org and to negotiate with us in good faith for at least 30 days; any applicable limitations period is tolled during this period. Notwithstanding the exclusive venue above, either party may instead bring an individual claim in small claims court in your county of residence or ours.
13. Privacy
In operating the Service we collect and retain certain information, including your email address, your date of birth, the network addresses from which you connect, and records — including date, time, and connecting network address — of your acceptance or refusal of this Agreement and of the certifications and releases described above. Where a provided date of birth indicates that a person does not meet the age requirement, we retain a limited record (including the date of birth and network address) for age-verification and legal purposes. We also retain records of donation transactions, including payer name, email address, and mailing address as provided to us by the payment processor. We use this information to operate, secure, and administer the Service, to maintain records of the agreements you have made, and for related purposes described when we collect it, and we do not sell it. Information is stored and processed in the United States. Our staff, including volunteer administrators bound by the confidentiality obligations of Section 18, may access logs and account records in order to operate the Service and to investigate and enforce this Agreement, and such records may be the basis of enforcement decisions.
Communications and actions within the Service, including chat channels, are not private and may be visible to other users, logged, and mirrored or relayed to third-party services such as Discord (for example, relaying in-game chat channels to corresponding Discord channels). Content relayed to a third-party service is subject to that service's own terms and privacy policy, and we cannot control or retract it once relayed. Do not share information in the Service that you are not willing to have made public.
Donations and other payments are processed by third-party payment processors such as PayPal. We do not collect or store your payment card or bank details; information you provide to a payment processor is handled by that processor under its own terms and privacy policy, and we retain the transaction records described above.
We may disclose the information described in this section where required by law or legal process, or where we believe in good faith that disclosure is necessary to protect our rights, the safety of users or others, or the security and integrity of the Service. The Service is not directed to persons under 18 years of age, and apart from the age-verification records described above we do not knowingly collect personal information from them.
You may request access to, correction of, or deletion of your personal information by emailing starhound@lostsouls.org. We will honor such requests to the extent required by applicable law, except that we retain records of agreements, certifications, refusals, age verification, and transactions after account deletion where needed for legal, security, or record-keeping purposes.
14. Donations and Contributions
Any donations or other financial contributions to the Service are voluntary and non-refundable except where a refund is required by applicable law. By donating, you represent that you are at least 18 years of age and are the authorized holder of the payment method used. Donations may be recognized with discretionary in-game acknowledgments (such as lux credits and the perks they can be redeemed for); such acknowledgments are a limited, revocable license and are elements of the Service subject to Sections 3 and 7, have no cash value, are not property, cannot be redeemed for money, and may be modified, revoked, or discontinued. Upon suspension or termination of your access for any reason, unredeemed lux credits and granted perks lapse without refund or compensation. If a donation is reversed, disputed, or charged back, we may revoke any lux credits and perks associated with it and may suspend or terminate your accounts. Beyond such acknowledgments as described at the time of your donation, donations confer no ownership of, entitlement to, or property interest in the Service or any element of it. Donations are not charitable contributions and are not tax-deductible; each party is responsible for its own taxes.
15. Copyright Complaints
If you believe content on the Service infringes your copyright, please send a notice to starhound@lostsouls.org including: identification of the copyrighted work; the location of the allegedly infringing material; your name, address, and contact information; a statement that you have a good-faith belief that the use is not authorized by the copyright owner, its agent, or the law; a statement, under penalty of perjury, that the notice is accurate and that you are, or are authorized to act on behalf of, the copyright owner; and your physical or electronic signature. We may, in our discretion, remove or disable access to allegedly infringing material, may notify the affected user and consider any counter-notice they provide, and may terminate the accounts of repeat infringers.
16. Changes to this Agreement
We may modify this Agreement from time to time. When we make material changes, we will provide notice (for example, on this page, at login, or by email) and may require you to re-accept the Agreement before continuing to use the Service. The current version and effective date are indicated at the top of this page. Your continued use of the Service after notice of a modification constitutes acceptance of the modified Agreement. Changes to Section 12 do not apply to any dispute of which either party had notice before the change.
17. General
This Agreement is the entire agreement between you and us regarding the Service and supersedes any prior agreements on that subject, except that any assignment, release, or certification you made before accepting this Agreement (including any in-game contributed content release or content certification) is not superseded, remains in effect as an independent obligation, and is confirmed and supplemented, not revoked or narrowed, by this Agreement. If any provision of this Agreement is held unenforceable, the remaining provisions remain in full force and effect. Our failure to enforce any provision is not a waiver of it. You may not assign this Agreement; we may assign it in connection with a transfer of the Service. You agree that a breach of Sections 3, 5, or 6 may cause us irreparable harm for which damages are an inadequate remedy, and that we may seek injunctive or other equitable relief, without bond, in addition to any other remedy.
18. Volunteer Participation
Participation in the Service — including as a volunteer developer, wizard, builder, or in any other content-creation or administrative role — is voluntary, recreational, and uncompensated. Such participation does not create an employment, agency, partnership, or joint-venture relationship between you and Telesmatic Systems, LLC, and you agree that you do not expect and will not claim wages, compensation, or any ownership interest in the Service or in Telesmatic Systems, LLC in connection with it. Volunteer status, and any access or privileges associated with it, is revocable at will, with or without cause and without any process being owed. Volunteers must keep non-public information obtained through their role — including source code, unreleased content, player data, and staff communications — confidential, and this obligation survives the end of volunteer service. No volunteer, staff member, or other representative is our agent or is authorized to modify this Agreement or to bind Telesmatic Systems, LLC.
19. Notices
We may give you notice by email to the address associated with your account, by message or prompt at login, or by posting on this site. You may give us notice by email to starhound@lostsouls.org. Notices are effective when sent or posted.

Records
When you make the certifications and releases described above, and when you accept this Agreement where prompted, your acceptance — or your refusal — is logged along with the date, time, and the network address from which you connected. These records are retained by Telesmatic Systems, LLC, including after any deletion or removal of your account, for legal, security, and record-keeping purposes.
